COURT FEES IN DELHI

DEAR SIR,
I HAVE A LEASE HOLD (RESIDENTIAL PLOT )JOINT PROPERTY IN DELHI AND THIS PROPERTY CANNOT BE SUB-DIVIDED ACCORDING TO THE LEASE HOLD DOCUMENTS.I AM HAVING 30 PERCENT SHARE AND MY COUSIN HAS 70 PERCENT..I AM RESIDING IN THIS PROPERTY ALL BY MYSELF WITH MY FAMILIY FOR PAST 35 YEARS AND MY COUSIN HAS NEVER ENTERED THE PROPERTY AS HE IS RESIDING OUT OF DELHI.NOW MY COUSIN IN THREATENING TO GO TO THE COURT AS HE WANTS US TO SELL THE PROPERTY.THE CIRCLE RATE VALUE OF THE PROPERTY IS ROUGHLY 1.5 CR AND THE MARKET VALUE IS ABOUT 6 CR..IF MY COUSIN GOES TO THE COURT TO CLAIM HIS SHARE THEN WHAT IS THE AMOUNT OF COURT FEES HE WILL HAVE TO PAY TO FILE A SUIT AGAINST ME AS WE DONT WANT TO SELL THE PROPERTY AS YET.

The Court fee is to be paid by your Cousin, why are you bothered about the quantum?

Dear Mr. Jitender, please indicate whether any undivided property can be sold by a co-owner without proper partition? Then how do you say that 'if your cousin sells the property to the extent of his share...'?

Undivided share can be sold. You seek injunction. as far as court fee is concerned, since he has been ousted from the property he would have to pay ad-valorem court fee. Rate of ad-valorem court fee are freely available on the net.

It would be handsome which may not bother the claimant in view of current market value which he intends to encash or he may also go for a deal for undivided share as well which is also bought by many investors at a premium in their favour !
You may seek injunction against any interference by the co-sharer or his nominee / representative !
