GPA adjudication

Dear Sir,
One of my client wants to sell his property which is in bangalore. The property is in the name of Husband and wife, since the wife is bedridden she cannot travel, so the client thought of getting regstd GPA from Mumbai where they are residing. In the sub regstd office they came to know that they have to pay 2% of the sale value.so my question is can they get a notorised GPA in mumbai and do a adjudication in bangalore? pls reply.

ans a notorised GPA shall not be a legal.

firstly tell the purpose of executing general power of attorney ? Only then i will be able to answer your query.

if your real purpose is to sell as u stated, then even if the wife is bedridden can be taken to sub registrar office. The notarised gpa will have no effect more than a waste paper.

Dear Mr. Anonymous,

I do not think that 2% of the sale value has to be paid to the Registration office when you only get a GPA executed in your favour, authorising to sell the property situated in Banglore.

That 2% charge will be applicable only if the property is situated in Maharashtra, and if the sale consideration is known. If sale consideration is not known how the 2% would be calculated. At the time of actual sale deed, the earlier paid 2% would normally get adjusted.

My suggestion to you would be, better visit the office of sub-registrar under which your residence in Mumbai falls, and make enquiries explaining the situation and also the fact that the property is situated in Banglore and not in Maharashtra.

You have to personally visit the registrar / sub-registrar's office and make proper enquiries.

A sees of conveyance can bot be registered on the basis of unregistered Power of Attorney. NO percentage is to be paid.
