Refund of wait listed unused railway ticket

Railway Ticket purchased from Reservation widow was Wait listed.
Not confirmed till Train Left Station.
So not allowed to travel
Next day Refund claimed , denied.
Can Passenger Claim refund of money from consumer court??? As for no fault on his side, he lost all money paid for ticket
Is Railway justified not to refund amount after a week???

Waiting list Tickets
These tickets are alloted after exhausting RAC tickets also. By using a waiting list ticket booked through online, you cannot travel in the train. But if the waiting list ticket is directly booked from some railway station ticket counter you can travel but no particular seat will be given to you if no vacant seat is available after filling RAC ticket to confirm. But in case of online waiting list tickets you cannot travel if it does not advance to at least RAC. The money you paid will be credited back to your online banking account through internet banking but some money will be reduced as service charge.
as per these rules passenger is entiled to refund .if railway refuses to refund file complaint before consumer forum

Railway rules stipulate that the refund has to happen within specified time. Otherwise it is assumed that the person has travelled using the ticket.

Refund Rules - Basic Rules (As on 1.5.2007)
1.These rules are called Railway Passengers (Cancellation of ticket and refund of fare) Rules.
7).Unused waitlisted or RAC tickets. -
(1) Subject to provisions of sub-rule (2), no cancellation charge shall be payable if a wait-listed or RAC ticket is presented for cancellation -
(i) upto three hours, when the ticket is for a destination station upto Two hundred Kilometres,
(ii) upto six hours, when the ticket is for a destination station of more than Two hundred Kilometres but upto Five hundred Kilometres, and
(iii) upto twelve hours, when the ticket is for a destination station of more than Five hundred Kilometres,after the actual departure of the train except for the deduction of the clerkage :
Provided that for night trains leaving between 21.00 hours and 06.00 hours (actual departure), refund shall be admissible at the station within the time limits specified above or within first four hours after the opening of reservation office, whichever is later.
(2)Where confirmed reservation has been provided to RAC or waitlisted ticket holder at any time upto the final preparation of reservation chart, such ticket shall be treated as a reserved ticket and cancellation charge shall be payable in accordance with rule 6.

you have to make application within 12 hours if distance to be travelled is more than 500 kms . rule 7 is self explantory

Dear Shri Shroff,
If a certificate is obtained from the ticket checking staff in the train regarding non-travelling of wait-listed passengers on such tickets, refund becomes possible to be obtained thereafter, as that becomes the proof of non-utilisation of ticket for the authorities to make refund.
