Encroachment in staying land.

(Querist) 30 March 2016 This query is : Resolved 
this is a story of my friend abhijit.
abhijits father have 2 brothers
(abhijits paternal uncle.)
all 3 (abhijits father and his 2 brothers) share 100 acre land in them and have 3 children each.
100 acre land is vatan land
now their fathers father(abhijits grand father)decided to give 50% of land to 2nd abhijits paternal uncle after death of 3rd uncle.this is not officially on records.
this 2nd uncle is cultivating that land for nearly 80yrs.
now the children of the deceased 3rd uncle are encroaching,creating havoc crime intrusion and asking for their share.
pls. guide what my abhijit could do.

Abhijit can file suit for partition.

If abhijit's grand father is died and the property is not divided and registered, Abhijit's father will get 1/3rd share in the property and Abhijit will get 1/3rd share out of his father's 1/3rd share.

If Abhijit's grand father is alive and the property is self acquired, GF can transfer the property as per his whims and fancis.
