Respected experts, If a wife takes away her 4 year old daughter with her when she moves away without informing her husband from matrimonial home after collecting TC at school, what defense her husband has for the custody? Whether it amounts to kidnap? If not, how can he defend his case on custody? Can that wife ask for interim maintenance from her husband when she has left matrimonial home all by herself? Any case laws? Please clarify Court's stand on this. It is urgent matter for me.

the husband take defense that without informing and took his child from matrimonial home, same time the wife can custody upto 7 years in female, after that court decided for primary querys, then you can ask to maintenance you must give reason to court.
