compoundable offence.

(Querist) 06 August 2010 This query is : Resolved 
1) In the compoundable offence "the complainant is having liberty to take complaint back against the accused person" It means settlement between the parties. In the non-compoundable offence, there is no such provision/permission is granted.

2) What is the process of taking away the the non-compoundable offence if the complainant want to take away the complaint back against the accused person.

As per section the point 1 says.

In case of non compoundable offence the complainant and the witness can detract from their evidence by saying that they are unaware of the commission of the offence by the accused and the case can be dismissed on the ground that is of no evidence. However, in this case there is apprehension that the court can proceed against the witnesses by declaring them the hostile witnesses, therefore, in this case the presiding officer of the court may be taken into confidence and as such when the matter is being compounded the court always take the lenient view.
