(Querist) 04 May 2010 This query is : Resolved
Dear Experts,

Need your advice.

Can we challenge the indemnity bond in the court given by us to someone which is only noterise and not registered?
As i have given one indemnity bond to my uncle to avoid a certain situation.
Now i want court to decide what is right and what is wrong.

if u admit that u have given that indemnity how can u challenge? not registering is just the irregularity and not the illegality.

yes i agree with Mr. Prakash. Indemnity meaning itself convey the whole thing

Dear Experts,

I agree that indemnity bond has signed and given by me but that was given to avoid certain situation. I was under pressure to sign it.

But let say if that indemnity bond is not registered and i take the help of court and file the legal case on my uncle than what will be court reaction. Will court stand on that indemnity bond or the will void it???

Yes my friend Indemnity will be valid and can be enforced as against you unless and untill u have a strong case in favour of you..what you mean by Indemnity not registered..its not required to do so...

No law makes the registration of an indemnity bond compulsory. So even if it is not registered, it will not affect its enforceability.

You are estopped from challenging the validity of a document executed by you.

why the provisions of indemnity bond can not be challenged in the court of law?
if there is any dispute over the provisions and applicability, it can certainly be challenged.
