Can the magistrate in his judgment go beyond
on facts or otherwise what has been stated by the Complainant ???

whether offences under section 4(1)A read with section 21 of mines and minerals act can be accompany with section 379 of indian penal code. whether a police officer can give complaint in respect of the said offence or whether he come under the defintion of section 22 of mines and minerals act

Dear Sir,
1)My parents and my younger brother are facing various wrong allegations from the wife of my younger brother & her family as they well connected with policians and bearucrats.
They have made some false complaints on my father and brother in Delhi & Noida area on thefts, although they have not lodged any FIR yet.My father and brother were summoned to these Police stations for several hours to harass them, however SHO did not provide anycopy of this complaint to my father and brother and started asking irrevalent questions that we are harassing the girl, and should stop the same. The girl also cried infront of the SHO to give an impression that she has been mistreated. Finally my father and brother were asked to sign on document that they will treat her properly in future. It seems there was pressure on SHO from some senior official connected to the wife of my younger brother & her family to register this false complaint.
Also my younger brother's wife has recently also lodged wrong complaint with the womens commission of harrassment by my younger brother and father, and womens commission has asked my father and brother to report to them in 1 week's time for compromise.
They are also scaring us that they will lodge false complaint under sec. 498.
Pls advice what we can do to prevent this harassment.
This all started because the wife of my younger brother and her family are eying on our property, and she also does not want to vacate the house currently owned by me in South-delhi where they are staying
2) sir,pls also advice procedure for asking my younger brother and his wife vacate my house. Is suit required to be filed before getting court order or any other procedure? what is the procedure. My brother wishes to relocate to another locality, so that there is less interfence on daily matters from my inlaws of my brother's wife.
pls also advice how my father and younger brother can legally protect themselves from false harassment and complaints for theft and other allegations from my younger brother's wife and her family.
would be indeed grateful..

Dear sir,
if family of wife had taken surplus money from the husband in the year 2008 and not returned till date.
money was taken under relation.
husband have no bank transaction record but
having messages how money was demanded and collected by the family.
can husband claims his money from the family of wife
is messages showing clear evidence that family having money of husband are useful for claiming the money through judicial system.

Sir/madam,
pls advise me-can I file criminal suit for defamation agst my wife as she charged me with false allegation of embezzlement of Rs 5 lacs from a company in divorce petition filed by her. two years lapsed from the dt.of allegation.I was outsourced by another co.(I have good character cerificate from this co.) and assigned temporary work in the co.with which allegation made.this co.says for filing suit and it will present truth while investigation.There is no offence like such. Is witness from my side necesurry during filing and progress of case.

Sir/madam,
pls guide me-can i file suit against my wife and her father as they have taken gold ornaments worth rs 1,50,000/-beyond FIR as almirah taken to PS,Alwar,Raj of which key was in possession of my wife and she drew all the ornaments and taken away while I and my father were under police custody u/s 498A. they have given the receipt of the same, bearing sign of wife and her father.police gave them without preparing 'Fard Jabti'report.Two yrs period lapsed.they have been promising to return the same but now they are not returning.I live at Bharatpur,Raj and my wife filed case in Alwar,Raj.Is my father required to file the case instead of me.can it be filed in Bharatpur.Is notice in this regard required.there is only my old father in my family.

How the investigating agency prove the demand in pc act?
How the agency and the court frame charges if more than one person is involved?
If charges in the chargesheet is like this Sec 7, 120B Read with 13(1)(d), 13(2) whether all charges are there or only 120B is the main charge
If the name mentioned in the complaint and the name mentioned in the FiR differ what it means?
(Not spelling mistake name is totally different)
If the complaiant and statement given later on completely differ?
If the transcription given by agency is signe by a person or independent witnesses who do not know the language in which it is spoken?
Work for which the complainant alleges to have made and demand made the work which is already one and relayed in the internet then for what purpose he paid or omplained
Voice traqnscription does not revel any demaqnd made by anyone the complainant himself forefully saying te amount that amount etc

DEAR SIR'S I AM MARRIED FOR LAST 30 YRS AND MY HUSBAND HAS BEEN BEATING ME SINCE STARTING. I HAD A SON AND I WAS HOPING THAT WHEN HE GROW UP HE WILL SUPPORT ME BUT WE MARRIED HIM LAST MONTH AND NOW HE WITH HER WIFE WILL BE MOVING OUT TO OTHER CITY AS THEY BOTH GOT A JOB THEIR SO I LOOSE ALL THE HOPE I HAD. BY HUSBAND STILL BEVAVES WITH ME VERY BAD AND ALSO GETS VIOLENT AT TIMES. WHAT SHOULD I DO? HE ALSO TELLS ME THAT EVEN IF I TAKE DIVORCE FROM HIM NOW AND AS WE HAVE ALREADY BEEN MARRIED FOR ALMOST MORE THEN 30 YRS I WILL NOT GET ANY HELP FROM ANY COURT AND EVEN NO MONEY. HE ALSO TOOK AWAY ALL THE CASH AND JEWELLERY I HAD. HE HAD ALSO TAKEN ABOUT 40L IN CASH FROM MY FATHER AS LOAN FOR THE MARRIAGE OF OUR SON WHICH ALSO NOW HE REFUSES TO PAYBACK.
