Decleration

a women is missing for more than 10 years(presumed to be dead). her husband is pre deceased and has no issues. no claims are been made from the husband's side. in such a situation, the brother of the missind women wants to file a decleration suit to declare that her sister is no more. QUESTION- to file a suit who and all has to be made as defendants and whether issuance of notice is mandatory. please suggest me what can be done..

Who so ever are her legal heirs have to be made as defendant.
