Pagdi System Laws

My mother stays in a Pagdi system room. She stays there for a few days and stays in my flat for a few days. When she stays with me, her pagi system room is closed and unoccupied. The landlord for that pagdi system room is not accepting rent stating that her room is closed and he wants her to sell the room.

One of our neighbours had a similar situation and our landlord took his room away through court.

Please let me know what are the laws related to this and how do I protect my mother's room being taken over by landlord.

In fact there are no such written laws in the form of Statute. In fact Pagdi system is a kind of lease agreement prevailing in some cities only. It shortly means permanent lease wherein the lessee has got right to assign his rights to another. One does not get ownership rights in such an agreement. The pagdi agreement is governed by the Rent Act, if applicable to the area. Otherwise it is governed by T. P Act.

So if the room remains closed for a few days and being used for a few days, is enough for us to protect the room or landlord can take the possession away from us through court?

You must consume electricity. The electricity bills would show that you are using the premises. Preserve letters and other correspondence received at the address of the premises. If you have phone bills at the said address, preserve them. similarly, the bank passbook also shows the address. There can be so many documents. Also take some photographs showing family members inside the premises.
