giving false information for marriage purpose

(Querist) 18 January 2010 This query is : Resolved 
a girl and her parents gave wrong information regarding body measurements of the girl to the groom and supplied photographs taken with tricks. the girl had claimed her measurements as 36 -26 -38 but actually the measurements were 31 -28 -35 which were known after marriage only. the husband is very much dis-appointed and feels cheated. what action can be taken in the matter ?

Section 12(1)(c) of the Hindu Marriage Act, 1955 says - "that the consent of the petitioner (means yourself), or where the consent of the guardian in marriage of the petitioner was required under section 5....., the consent of such guardian was obtained by forced or by fraud as to the nature of the ceremony or as to any material fact or circumstance concerning the respondent; or

Now, the concealment of fact or fraud played against you regarding her meansurements are not material. The measurements of a person are changeable in due course of time. The court may feel, further, such insistence on your part in respect of measurements amounts to degrading the womanhood and treating her as pleasure toy. Hence, the marriage is not voidable. After all, what is there in the body? It finally be eaten away by the insects in the grave yard after death.

You have no option but to live with her. Do not look only at her beauty but also look at her character, conduct, manners and humane behaviour. What if a beautiful thin female becomes fatty and ugly after the marriage.

The measurements of a person are changeable in due course of time. It is better if you live with her peacefully.
