Excise exemption form notification no. 15/2010 ce

Dear Sir,

Can we appeal against penalty if we failed to give the prior intimation to Deputy Commissioner of Central Excise under notification No.15/2010 CE dated 27.02.2010 of Exempted Goods clearance.
