APVAT INPUT

Purchase Order from Andhra Pradesh (A.P.) state has been placed to a AP party.but under the terms of P.O. godds directly will be supplied to the customer i.e. Maharahtra state. Supplier is charging the VAT @14.5% th. VAT Invoice. whether the Vat amt. paid by me is eligible for input credit? what are the documents to be annexed to Department at the time of claiming the VAT input?
Pl. explain in detail....

Octroi

Dear Sir,
I have a query on Octroi rules, the query is whether it is possible to pay Octroi on a lower amount than the invoice price, if so whether there is any notification regarding the same. I would also add more matter, basically we send our goods at say Rs. 100/- MRP to our franchisee who sells it at that price to the retail customer and we give say 30% commission to our franchisee on that. Now we want to pay octroi on Rs. 70/- although the invoice price is Rs. 100/-

income tax

a survey was conducted by income tax people and an ordered was passed . and a demand of rs 40 lakhs was raised by assessing officer and ito called for hearing no reprasentation and an order was passed under best judgement. after completion of 2 years from passing best judgement now ito issued show cause notice why assesse can not be arrested . what is remidy available to the assessee. he is not in possition to pay the amount, whether the assessee can preffer an appeal if so under what provision

Proceeds from sale of property

Property bought for Rs. 30,000/- thirty years ago.

Now sold for Rs.18 Lakhs.

What would be Tax Liability and under what law?

Income Tax Deduction

Dear Sir,

Recently wage revision for Bank Employees has been finalised and another pension option has been offered for which existing PF optees have contributed 2.8 times of their revised Pay for the month of Nov, 2007. This amount has been kept by the Banks with them but I-Tax thereon is being charged/paid. Sir, when payment of such amount has not been made to employees, why TDS is being deducted. Is it right as per rules? Mr. Azim Khan has commented as:

"T.D.S. is generally deducted at the time of payment or credit, whichever is earlier."

But in this case neither payment nor credit has been given to the employee and the funds have been directly credited to Pension Fund Account maintained by the Trust.

Reply to my above question "tax is to be deducted as the amount has been credited to pension fund". But, Sir this is the case of 2nd pension option for which the Banks have charged extra amount said to be shortfall in pension fund. Pl review the case in this context.

SERVICE TAX RETURN

SIR,
ASSESSEE ISSUE INVOICE BUT NOT COLLECT SERVICE TAX BECAUSE OF TURNOVER IS BELLOW THE EXEPMTION LIMIT THEN THE SERVICE TAX RETURN HOW TO FILE NIL AND FILLED THE GROSS AMOUNT DETAILS

National Calamity Contigent Duty ( NCCD)

Dear Sir,

I require the following clarifications.

Whether NCCD is excise Duty.

And If any company is exempted from paying excise duty whether any duty is required to be paid under NCCD.

Income Tax

One trust has been merged with another trust on 31.07.2010.

The trust which has been merged wants to close its operations and surrender its pan number.

Can the trust file its income tax return from 01.04.2010 to 31.07.2010 now before the closure of the previous year 2010-11.
