Query

Hello All,

Could any one please tell me that an employee be terminated during his/her notice period of 2months.

Note: Termination happened a week prior to the last day of his notice stating that client protocol not followed.

Thanks in advance.

The employment can be terminated during the notice period.

In the matter cited by you the reason for termination (misconduct) seem to be cited.

You may download the HR policy, service rules, conduct and discipline rules, severance policy etc of the company and find out if this is the reason stated by the company due to which employment can be terminated.

You may also look into the facts of the matter and check if there was any such violation at your end, as cited by the company.

Did the company issue any show cause notice and provide proper hearing before effecting the termination?

What is this establishment: Industrial or Commercial?

You and redg. office/HO of the company is located in which state?

Do the standing orders (certified/Model) apply to the establishment and does company have its Certified Standing Orders? Standing Orders should have been displayed near entrance on notice board.

What is your designation and nature of duties?

Does anyone report to you?

It shall be appropriate to show all of your docs to a competent and experienced labor consultant/service lawyer give inputs in person and proceed under expert advice of your lawyer. The lawyer that has seen all of your docs and has analyzed your inputs can advice you the best.
