This is regarding a builder who is delaying the completion of common amenities and has not yet given the occupancy certificate for the flat. Delayed completion by 5 years. All individual flats are complete, people also staying there. Common amenities like stairs, parking, pool are incomplete. Builder has collected all amount from each flat owner( registration, panchayat tax, building tax, water connection et al). During the registration, he mentioned that the area is not in panchayat but is now under Municipality. Therefore he charged a higher rate. We know that he owes some of us the balance from the excess we had paid but he definitely doesn't want to return. All these years, we got answers from builder that he will complete the pending work in 2 months. Also he acted helpless on his response as to why house number is not yet allotted from municpality putting blame on Municipality. We have't got any valid Govt receipt for the tax amount that we had individually handed to builder. Flat is registered and we have the sale deed. Electricity meter connection and bill is fine- we get in our own name. No owners association is formed because we want completion first. Maintenance is being taken care by builder but by charging higher monthly amount. We all continue to pay that. Please advise:
1. How to get house number allotted from Builder (..ie municipality)? Looks like Municipal engineer and builder are together in this fraud.
2. If builder says that Municipality has asked to pay x amount when finally he tries for house number allotment, what legal route can be taken to fight this unfair demand?
3. In this situation as of now with only sale deed in hand and no house number allotted, can I sell my flat? Or do I need Builder support for that?
