Dear Sirs,
I am planning to buy a property in Gurgaon which was
1) Allotted to A by Ansal API 25 years back but no allotment letter is present 2) A sold this property to B 20 years back. 3) B made a GPA in name of C. 4) C sold this property to D. 5) I am planning to buy it from D.
I planned to get it financed by one of the leading banks, but certain documentation related questions are being raised. My problems are:
1) D is saying that Ansal did not issue allotment letters and therefore he does not have one.
a) How to find out if an allotment letter was issued by Ansal 25 years back?D has possession letter though.
b) If a letter was issued but seller has lost it, what steps are needed to be taken as allotment letter was in name of A whose whereabouts are unknown?
c) What problem I may face in future if I continue buying this property? What steps I should take to ensure that I do not fall in problems in near future?
2) The GPA made by B in name of C is of different date than as mentioned in the sale deed of C to D.It seems to be a printing mistake as only year part differ by 1.
a) What steps can be taken by D or me to rectify this mistake?
b) Can this mistake create problems in future? What should I do to avoid any problems?
3) I have already paid 25% of the agreed sale cost to Seller and this amount is documented in notary in form of stamp paper worth 10 Rs.. I have already done ATS with D in which it is mentioned that all amount needed to be paid by me 15 days from now..
a) What legal steps can I take against D if I do not intend to buy this property due to these documentation errors and if he refuses to pay back the amount?
