Municipality order for feeding point inside gated apt for stray dogs

Hello Expert, 

Summary: Some stray dog feeders feeding on entrance gate and next to school bus stop. compare kids with dogs in whatsapp grp  and want to use kids playarea etc for dogs. residents opposed and asked to move feeding point away from gate and school bus stop. Police and Muncipial office visited and provided fixed place away from gate and police said NO stray dog inside gate. But later Municilpality issued order declaring feeding point as temporary and asked builder to provide feeding point inside complex. With inside complext dogs have access to parkings, play area and clear threat to safety of childrens. Many instances already happened on gate of dog chasing. Other that Municipal blamed lot of false blames, accusations to residents and threat of FIR. Municipla totally ignore all concerns and evidences from resident and spoke feeders language. AS per order security not supposed to stop dogs inside or clear path. Attached order copy... Please suggest what canbe done to save childrens and pedestrations inside complex.

Information could be sought, under RTI Act,  from the Municipality as to the Law under which the said Order has been issued. In the absence of any  legal provision enabling the issuel of such instructions, the Order is legally unsustainable.

Your query is a surprise because the orders what you have attched to your post very cleary describes dos and don'ts , hence following the instructions and the orders scrupulously is the only option before you.

If you are aggrieved by this order then you can very well prefer an appeal against the orders before the appellate authority or approach civil court with  suit for mandatory injunction to set aside the orders passed by BBMP and to restrain the authorities from passing such orders in future too especially keeping in mind the safety concern of the inmates/residents/children of the gated comunity.

Thanks for the response, resident's concern is it is based on wrong number of dogs, location and don't care about safety of human (children/diabled/preganant woman specially) and ignored fact that feeders use school bus stop and entrance for dog feeding. Looks like in India all laws are favoring to dogs an no human safety is considered.

File writ petition of MANDAMUS in high court against said order.

Contents of the Order make a strange reading and  is of no legal standing. No such directives could be issued based on Art 48A and Article 51A.

Perusal of the Record of Proceedings in CIvil Appeal does not confer any powers upon Municipal Corporation to issue such directions.

You have the option to approach the High Court in a Writ Petition.
