Builder has no right to retain entire advance paid amount on cancellation of deal.He can deduct 10% of advance paid amount in liew administration charges only It's not only unfare trade practice of builder but also amounts his deficiency in services. File complaint before Consumer Commission and claim advance paid amount along with compensation towards mental and physical agony.

First issue a legal demand notice stating that subsequent to the cancellation of the booking he is required to return the advance amount failing which he will face legal consequences.
After that you may first lodge a criminal complaint with the police for the acts of cheating by not returning the money and then you may file a money recovery suit in a civil court or approach consumer commission for relief and remedy
