In India, the legal process for filing a case against a spouse and seeking custody of a child can be complex and varies depending on the specific circumstances.

Are your children minors?  If your children are minors, pray to the court for visitation rights, and if they are majors, they will live with you and their mother.

If your children are moinor by age then you can ask for their custody through court as per procedures of law, if they are major by age then you cannot do anything about it.

He is only 8 year old

You can, therefore, pray to the court for visitation rights.

Nothing more could be advised at this stage.  In this situatin when the Mother is disturbing studies of child then it can be argued that the future of child is not safe.

Your allegations are less than factual and immature. How could the mother be blamed for the child being not successful in NEET? After all, it is an entrance examination, not a course of study. May be that particular stream is not her strenth: the child could be having a different aptitude.

A definite cause of action is required for approaching a Court. Your postings disclose none.
