Criminal non compoundable

My one querry ragarding the offence of non compoundable offence how settle in court of law?

the offence booked u/s 384, 420, 467 and 34 of IPC. yet the charge no framed against the accused. The case is compromise between the accused and complainant out of the court. So how the matter settle at court? the procedure ?

You may settle the issue out of court, and after the settlement, you both submit a withdrawal of the case before the court.

The High Court can permit such matters to be settled.

The trial court cannot dismiss the criminal case pertaining to non compoundable offence, however the affected party may approach high court to quash the charge sheet/FIR on the basis of compromise settlement between parties and the respondent should appear in person before high court and express no objection by filing an affidavit to this effect.

Once the High court has quashed the FIR then the accused can file a discharge petition before trial court for relief.

Chargesheet is came on record. The court yet not framed charges against the accused. But out of the court matter settle between the accused and complainant.

The non compoundable offence cannot be closed by trial court on a compromise between parties. 

The accused has to approach high court and follow the procedures as suggested earlier to get proper relief.
