Can a husband file harassment case against wife and her family?

My wife is already filed a 498-A case against me and my family on May 2024. After 15 days, due to the harassment my in-laws family my father is passed away.

 

In July 2024 I filed RCR case and In November my wife filed Maintenance Case. In June 2025, I filed an IA application for to get interim visiting rights to see my 2 years son.. All cases are under processing presently..

 

Now, 15 days back I went to my wife's to native place along with community elders and meet their community elders and requested for the discussion to settle the issue b/w elders..

 

After this, My wife given a harassment complaint by saying that I had spoken badly about their family... Police were filed FIR against me.

Actually they were harrsing me and my family. I saw my son 1 year ago, my father passesd away, my mother health not well.. I'm suffering mentally..

Now my question is.. As a husband or a Men there is any possibility to file a FIR for harassment against my wife or women? If it is possible please let me know under which section and which act? If that is not possible, is there any possibility of my mother will file a FIR for harassment against my wife and her family?? Please reply 🙏🙏🙏 I don't have any other way..

There are 3 pending cases in court. Now, it is not advisable to file FIR against your wife and her parents.  Consult your counsel for their opinion, who is familiar with the details of the cases.

It's  waste of  time. 

My personal  opinion is that all family  courts are  lenient  towards  women.

So, allegations  like  wife  used filthy language  will not  give  any  merits  to your  pending  cases.

Better  find  ways to  fight  aggressively in  your  on going  cases  to win.dont waste  time and money  with  new  cases.

Unlike the usual misconception, wives are not the only ones who face mental harassment in a marriage, but it can be the husband too.

While certain provisions have been laid down to protect women from falling victim to harassment, there are no laws that would do the same for husbands.

It is somewhat unfair that there are no regulations safeguarding men from injustice in matrimonial cases while women have several laws in place to protect them in such cases.

There are a lot of men who face mental harassment and cruelty from their wives.

However, there is really nothing that they can do about it.

Some corrupt wives abuse the protection provided to them in matrimonial cases and use it to make their husbands suffer.

While a woman can get the society’s support simply by claiming that she has been beaten up by her husband for dowry, a man cannot make any harassment claims, as not only will it not get him any support, but he will also end up making a fool of himself.

Matrimonial laws have been legislated gender baised.

Make sure to settle issues amicably or suffer with similar other fabricated package of case(s) .

Prima facie it is a moot court / time pass topic for debate, which should have been discussed with your professor / coach / tutor.

However, if it is a true story, it is advisable to contact, consult and engage a local prudent lawyer for proper analyses of facts and professional guidance.
