Co.op.hsg.society mumbai, maharashtra

We have 13 Flats in Co Op Hsg Society Mumbai at Vile Parle West having Built up Area as under: 5 Flats having 830 Sq.Ft. 5 Flats having 970 Sq.Ft. 1 Flat having 1124 Sq.Ft. 1 Flat having 1830 Sq.Ft. 1 Flat having 2910 Sq.Ft. The Total maintenance charges for smaller Area Flat is ₹13/- per sq ft and for largest Area ₹ 5/-per sq ft. This is very unethical. How to resolve this under Model by laws or any Other prevailing Laws or Court Rulings.

Your issue can be resolved by understanding the relevant laws and regulations, reviewing the society's bylaws,checking for court rulings or precedents, seeking guidance from relevant authorities, and negotiating with the society's management.

What are the terms and conditions of the bylaws of your society?  If the opposing members raise this issue at the AGM of the society?

In Mumbai, apartment maintenance charges are typically collected using a combination of methods, often involving a mix of per-square-foot charges and equal distribution for common expenses

Some societies also incorporate charges based on amenities used. 

In some societies, all residents pay an equal amount for maintenance, regardless of their apartment size.

Many societies use a combination of both methods, balancing the need for fairness and practicality. 

 

Some costs, like security or staff salaries, may be divided equally among all residents. 

 

Other costs, such as those related to common amenities or building maintenance, might be charged per square foot

You have 13 flats in a co-operative housing society. Are all the flats occupied by you or have you given them out on rent to tenants? Maintenance charges is a loose term. Under the Model Bylaws there are several charges payable by each member. Charges like Sinking Fund, Repair and Maintenance Fund are payable in proportion to the area of each flat. Municipal tax is fixed by the Municipality and members have to pay on actuals basis. Charges for common electricity, salaries of Society employees etc are shared on an equal basis by each flat irrespective of the size of the flat. Actually the byelaws say "equally by each member" because co-operative law expects a person to own only one flat for his own residence.
