Guards asking for permanent employment

 I am working in a PSU oil industry, through contrctor we have arranged security guards for depot's security as per DGR guidelines, monthly we were disbursing payment to conractor through e payment, upon dis empanllement of contractor by DGR,company as principal employer paid their wages through cheques for seven months, during  change of contract gurad we came to know that they have filed a case against company for permanent employment. 

all four guards working with company through contractor with more than 3 years,please advise what should be our course of action in this regard.

(c) The contract is for a specific period of two years, generally extendable by two more years vide OM No 6/22/93/GL-15/DPE (SC/ST) dated Feb 1, 1999.

ya sir, it's  true that contract can be increased by two year, but said security agency was Dis-Empanelled by the DGR so upto new Tender/Contract  company paid them directly.

have you paid the PF/ESI also during 7 months or just evaded.

 

have you /how yo ensured that contractor has deposited PF and ESI dues. If contractor has evaded then this will add to your trouble

 

After contract you start paying them and now they are you remployees.
