Corpus fund utilization and replenishment policy

Dear Sir/Madam, Greetings! Our association (In Chennai) is currently reviewing its byelaws and financial management policy, particularly the utilisation and replenishment of the corpus fund principal and the interest earned on it. As different views have been expressed on this subject, we would like to understand the practices followed by other apartment associations before finalising our policy. I would appreciate it if you could share your association's policy or practices regarding the following points: 1. Corpus Fund Principal: Is the principal amount preserved without utilisation, or can it be used for emergencies or major capital expenditure? If utilised, is replenishment mandatory? 2. Corpus Fund Interest: Can the interest earned on the corpus fund be used for approved purposes such as capital improvements, infrastructure development, or emergencies? If utilised, is replenishment of the interest amount required? 3. Approval and Governance: What approvals are required to utilise the corpus fund principal or its interest? For example, is approval from the Executive Committee sufficient, or is a General Body resolution required? 4. Reserve Fund Management: How does your association maintain a balance between preserving long-term financial reserves and meeting the community's infrastructure and maintenance requirements? For our internal discussions, some of the residents are considering the following general principles: - Corpus Principal: Preserve wherever practicable and replenish if utilised, subject to the applicable rules and approved policy. - Corpus Interest: May be utilised for approved purposes, with replenishment not ordinarily required, subject to the applicable rules and approved policy. - Governance Principle: Preserve the principal reserves while allowing the earnings to benefit the community through appropriate and transparent utilisation. We understand that the applicable legal requirements, registered bye-laws, and the terms under which the corpus fund was collected may influence these practices. Our objective is to establish a transparent, consistent, and financially sustainable policy that serves the long-term interests of all residents. Your association's experience and recommendations would be very valuable to us. If available, we would also appreciate it if you could share your association's written policy or relevant bye-law provisions on this subject. Thank you for your time and support. I look forward to learning from your experience.
