Crpc 125 maintenance

Respected Experts,

Divorced wife filed maintenance petition under CRPC 125 before the Family Court. Th judge has sent it to the Counsellor for mediation.

I would like to know what is the need of counselling as she is a divorced wife. The case can be decided on merit.

What should be told to the counsellor.

Your wife can file for 125 crpc. Court rightly ordered for mediation try to succeed in mediation if not file the case on merits . The judgement of divorce will play the major role when deciding the case on merits

it is as per law , so no new thing , she need money to live her life ,

you have to prove that she do not need your money as per law , show her new marriage if done, tell her education . job, livin relation , property, fixed deposit, share and debentures ,other source of earning, adultery etc etc

if you cannot prove any of above then kindly pay her money , its very simple logic.

Hi Manku court take give you right way to save your married life and their onehope for yoou if you take part in medition and you and your wife will agree for live 

medition process thats out of court and its only for save relation when court see some hope to save relation than issue order for medition 

so not worry about and join medition if you both not reach on way than meditior give repor to court and your case would running in court

Court has send in mediation so that case can be solve mutually. It may possible counselor help you to come on mutually points to close case.

Thanks experts. It was a contested divorce. Instead of filing her petition under HMA 25 for permanent alimony she has filed under 125 CRPC for maintenance. I dont understand what is the need for counselling who is not a wife anymore. The case should have been decided on merit itself.. Regards

Dear Manku,

if you are not interested in mutual settlement then don't agree on her demands..

Basically you wrote judge said to both of you for mutual settlement so it is always advisable to show respect towords courts.

You go there and reject her demands and after that case will be proceed
