After sale problem in free hold property

I am residing in a 3 storey building constructed by a local builder 10 years back and now there a seapage issues due to some flats same as from the flat above my flat and owner is not ready to take action and it is causing damage to my costly paint also growth of insects and parasites inside my home.What legall action can I take to rectify this issue and claim my loss from the owner.please guide

Generally builder's warranty is for one year from handing over possession of the building, which differs from an agreement to another.

Seepage / peeling paint after 10 years of handing over shall have to be repaired by owner / occupant, if there is no clause in the agreement.

Sir my question is what action can be taken if owner of the flat is not taking action to repair the problem.

I am the victim whose flat is being damaged by the leakage above and its owner is not taking any action to prevent it.What legall action can be taken or how can I claim my damages from the owner of other flat ?

You can adhere to the following steps for addressing the seepage issue and claiming damages:-

 

i.                 Issue a legal notice to the flat owner above you, highlighting the problem and demanding corrective action. This can be done under the provisions of the Consumer Protection Act, 2019, seeking compensation for the damage caused to your property due to their negligence.

 

ii.               If the owner fails to respond or refuses to cooperate, you can file a complaint with the Local Consumer Court or the Real Estate Regulatory Authority (RERA). The court could direct the owner to rectify the seepage issue and compensate you for the damages incurred.

 

 

iii.             You can also rely on the principles of tort law, specifically the principle of ‘nuisance’. The leading case of MC Mehta vs. Union of India established the concept of absolute liability for harm caused due to hazardous activities.

 

iv.             Document all the damage caused, gather evidence (such as photographs, receipts of repairs, etc.) and seek legal counsel to navigate the intricacies of the legal process efficiently.
