My brother and is wife are living seperately since 18 Oct 2011. They want to file a mutual consent divorce petiton. But since the seperation period is less than 1 year, our lawyer suggests that we mention in our petition that they have been living in the same house since 2nd Oct 2011 (she came back from her parents house on 2nd Oct 2011 after a period of 7 months but gain due to differences left on 18th Oct 2011). Is this allowed or would there be any risk later?
