Sale of perperty which is in joint name

Hi,

i have a flat that is jointly owned. this flat is taken under home loan which is also jointly owned. it is jointly owned by my wife. now my wife is not staying with me from last 6 months and she is now asking for divorce.
i have paid all EMI's along with own contributation amount of flat uptil now.
she had only paid around 1 lakh 20 thousand as service tax to builder.


Is there any way that i can get my property back using power of attorney if she mutually agrees to sign it or is there any legal way that i can get my flat back ?

Please suggest.

Curretly flat original documents are with bank.

Since the property is hypothecated/mortgaged check with lender/Bank.

She may dispose her share by a valid deed e.g; gift/sale/relinquishment/release/transfer etc etc 

Check with  your own very able counsel of unshakable repute at your location handling Family/Civil matters and T&C drafted for your agreement.
