Refund of stamp duty

-          I have booked an under construction flat at Pune. I have entered into an agreement on 31-Dec-2012. I have paid stamp duty amounting to Rs. 266800 and Registration fees amounting to Rs. 30000. I have cancelled the flat. Now i want to claim refund of stamp duty. Builder is not ready to hand over original agreement to me. Please advise how can i claim refund of stamp duty.

If that agreement got registered with sub-registrar or not ? Once it  get registered, you are the owner of the flat.  the stamp duty cannot refund. Better to complele sale proceeds.
