Patta is priority or pahani & passbook?

Sir,

I am Sidda

My Father Krishna has a brother Linga.

Krishna:  My father , Sidda , I am the only son

Linga:  Has one son Mutyam.

Properties:

My father Krishna has 20 acres of Patta land, In sub registrar the land is still on my father's name.

In 1982 Linga died.

In 1991 Krishna died

In 1997 VRO changed the Pahani , with pen he entered Mutyam name for 10 acres, I opposed, filed compaint, but Mutyam was very rich and cunning, no officer helped me. Mutyam occupied my 10 acres of land when I was in hospital. I filed case, he threatened lawyer to withdraw case. Mutyam got passbook also. Mutyam is saying he bought the land.

I deeply investigated and found that there is no EC, no single doument to say he bought it. Revenue department is accepting that there is no single doc.

Can I file a case to cancel this passbook and change Pahani as Patta is on my father's name? Who will win in this case?

  • The right to a share in the ancestral property comes by birth.
  • The share of each generation is first determined and the successive generations in turn has to sub-divide what has been inherited by their respective predecessor.

Is the said statement/acceptance  of revenue dept verbal? : Its verbal , The revenue department is so afraid to give anything official. 

 

Sir simple case : My father has Patta , the opponent does not have valid EC to show he bought it. He is not an ancestor as he is cousin brother. But he changed Pahani and Passbook. Can I cancel his Pahani change and passbook?

For example: If the revenue department says He is a valid buyer, then He will have to go for Registration, then it can not happen as my father has died and I am the only son.I must have to sign to make Registration on his name. Please let me know If this is well enough to defend him?
