File case against subregistrar

Hi Friends,

 

4 years back i bought a land in madurai. Later found that it is "Adi dravidar Natham" land. So only Adi dravidars can buy/sell. I came to know that i am cheated.

Now i wont be able to get patta as well i can not sell to non adi dravidars.

But this should have been stopped by subregistrar as they know this information. Even i got EC before land purchase, in EC this Adi dravidra natham detail is not there. So i like to file case against sub registrar office to get penalty amount. Please let me know if i can do this. If so, how can i do this.

please help.

sathis, has initiated an interesting thread. Valuable opinion of learned experts/members is sought.

It is believed that "Adi dravidar Natham" is or a kind of ST community.

Encumbrance is not recorded and reported in majority of the cases Pan India. Sub Registrar do not object in almost all the cases and thus let the fraud happen and later cheated party is dumped in courts for years.

Kindly, give your valuable advice on the relevant laws and citations to help the citizens.

It is believed that "Buyer Beware” can not be cited to escape from penalty by the law enforcement agencies.
