We have let out our flat in pune on leave license basis to a tenant where in we have specified that flat to be used only for residential purpose and get regn cannot be taken on the flats address.now tenant is asking us to issue a no objection certificate for obtaining shops and3stablishment regn and creating website etc. Can we issue the same. If yes what will be implication
to us such as higher property tax from corporation ,higher charges from mseb and highersociety charges from society or eviction of tenant from the premises. Pl guide us how to proceed further

Quick Summary
A landlord in Pune is seeking advice on whether to issue a No Objection Certificate (NOC) to a tenant who wishes to use a residential flat for commercial purposes, specifically for obtaining a Shops and Establishment registration and creating a website. The landlord is concerned about potential implications such as increased property tax, higher utility bills from MSEB, increased society charges, and the risk of tenant eviction. While there's no legal obligation to issue an NOC, landlords are advised to ascertain the tenant's proposed activities and consult local authorities or a lawyer regarding the potential consequences.

"obtaining shops and3stablishment regn and creating website"!  have you ascertained the acitivity the tenant proposes to engage.

anyhow, this is a matter at the discetion of the flat owner; there is no legal obligation that the NOC be issued.

No problem in issuance of NOC for registration of your tenant under the provisions of Shops & Establishment Act / Rules of your State.

It is better to consult concerned authorities / local prudent lawyer qua implication of NOC regarding different laws applicable viz; corporation tax, MSEB & society and/ or other charges.
