Dear Sir

My father was working in arregation department and died before retirement in office service book he has nominated to all his children , my mother was already died earlier and he had done second marriege through Arya samaj in 2010, while he has not nominated her in service book ,

 

Is she able to clamte for pendtion nad other benifits please reply.

 

is Arya samaj marriege is vaild as it is not registered in court

Certificate of marriage is a legal document, which provides valuable evidence of marriage.

if her name is not in service book record wheter she will be able to get all benifits

she has to prove marriage and she can do so with the certificate which you said she has.  She will get pension share.

you have to understand and live with the fact that

  1. wife is not guilty if husband does not report marriage to his deptt.
  2. It is Govt employee not spouce who has to get the record updated.
  3. MARRIAGE IS PERFECTLY LEGAL  unless you have more facts to disclose.

Pension and DCRG No son (married above the age of 21 ) or daugheter (married or above the age of 25) or starts earning prior to such age, will get pension even if nominated. 

 

GPF spouce cannot be excluded. The nomination is illegal. So successsion certificate will be needed.
