Perjury is a criminal offense committed by a person who, having been sworn to tell the truth in a matter pending in a court of justice, willfully and deliberately lies. To constitute perjury, a statement must be made under oath in a judicial proceeding and be material to the issue being tried. If a witness makes a misstatement unintentionally or a mistake is made, it is not considered perjury.you can file it immediately. Records remains in the family court only.
