Alimony/maintenance decision

Hi i have filed RCR in july 2013. my wife has filed DV case and maintenance case. my marriage took place in june 2012. she went for her final sem exam in april 13 and after examinations she rejected to return to my home. she started to put condition like i have to stay away from my old aged parents. The marriage duration when i filed RCR was 1 year. i have 19500 gross salary. my deductions are 1900 EPF, 3800 LOAN EMI, 4400 LIC PREMIUMS. My net salary is Rs.9400. I have depended old aged sick parents. My wife is staying in small village. How much can court order the alimony for her.

If one time alimony then how much amount can court suggest to pay for her.

Gross salary minus PPF, insurance, all expenditures [medicines, petrol, internet, power, telephone, insurance for vehicle, health insurance, life insurance and other such expenditure, ], all  loans = take home salary. 


On take home salary 1/3rd is calculated as maintenance, but make sure that you show bills for such expenditure which you are showing to court, say bills for last 6 months.

and Adding further,

 

1. The more your expenditures and liabilities been shown with proof, the more less maintenance calculated on your Income.

 

2. The more your Lawyer argues with suffice of her earning and not sitting idle like a parasite, the more less or no maintenance will be calculated on your income.

 

3. For final alimony court judges husband and wife both according to their status,income,expenditures and liabilities,properties and assets,chances of remarriage after divorce,duration of marriage,if any child from the wedlock  etc.

If gross salary is 2 lakhs per months, Rs 50 000 goes as income tax itself . Rest deductions PPF 10000, home loan EMI 30000. Take home post this deductions in salary slip is 1.4 lakhs. Will income tax will be accounted or not in such case.
