Workers’ welfare cess act

Sir,

I am working in a construction Company which is involved in Industrial Construction work, we have completed some construction work and raised the final bill but the Principal employer is saying to deposit the cess under "THE BUILDING AND OTHER CONSTRUCTION WORKERS’ WELFARE CESS ACT, 1996" .

In our workorder there is no clause regarding the above cess.  

As we know that the, it is mandatory to deposit the above cess.

But I want to make clear that, it is the libility of the Contractor or Principal Employer to deposit the above cess.

any statutory liablity towards contract workers are the liability of the contractor. If the work order/ternder was cost +plus model, then the contractors builds in all components in the costing. Even otherwise, it it the contractor's liability, unless specifically agreed in the contract between the contractor and the principal employer, for reimbursement of the cess.
