Withdarwal of case

We filed a case against builder in session court for conveyance deed. Due to delay in court proceeding we filed for deemed conveyance. We were told to withdraw from session court. So we filed application for withdrawal. Can defendant object for withdrwal of case? He is delaying for various reasons.
