I am in badly need of your help. I am new here. I have a very peculiar case.
On last 20.11.2011 I was married to a girl in the same town of mine. The marriage was totally an arranged one and Hindu social one (registration was not done).
Suddenly on last 18.05.2012 she left my home and went to her mother's house which is situated at less than a km distance. after 4 days when my sister went to her house her parents (not she) declared that she would not came back to my house. Simultaneously she warned us if we take any legal action they would file a case of 498A. (In this connection I must let you know that their family members and relatives are attached to the ruling party and so, no lawyer of my town is ready to help me).
Then her mother demanded all her things which they had given during marriage along with the ornaments which I returned on last 19.09.2012 and amde a receipt (on a Rs. 20/- Non-Judicial Stamp Paper) from her when they confirmed that after one year of marriage they will propose us to file a divorce on mutual consent.
But from then on they remained totally silent. the one year of marriage had passed on last 21.11.2012 and one year of separation has also passed on last 18.05.2013. Again if we say anything, their only reply is that if we take any legal action they would file a case of 498A.
Now, I am totally helpless since
1. They are not ready to say anything.
2. I don't know what to do now
3. i don't have any lawyer with me here.
Now, can I send a notice to her? Can I file a divorce against her? can I start the case directly in the HIgh Court? Can I start case without any lawyer?
Please please help me out
