Two marriege

@Querist,

1.File a criminal case under section 495 of Indian penal code.

2.File a Civil suit for damages.

1. you have not stated wheater he had taken divorce from first or not if not hen file criminal case 495

2.  also she can claim alimony and

3.  if there is any harassment then she can file 498A

1.  you cannot file 498a for harassment.  498a is for harrassment specifically for dowry.  it is highly unsruplous of people recommending 498a at the drop of a hat.

2.  trying to get into litigation for teaching a man a lesson will give you and your sister too a lesson.

3.  for 5-6 years living was o.k. for your sister now it becomes hell suddenly after you know of some facts.  you need to do a lot of re-thinking on this.

she came to knew about this after 2 years of her marriege and didn't tell us just because she thought that her parents will die when the will know

now he is planning to live with her first wife but didn't said it.
he drinks and start fighting with my sister and even with his own mother. sometime beats her

he don't know how to live in the family..

this legel case is different this. he has to suffer more than that

please advise

Even though I would be the last person who would suggest you to file a 498a case.

But looking at the matter, file not only 498a case, beating, drunkard, file a DV case also.

Claim maintenance u/s 125 crpc, HMA blah blah.

For bigamy he go to prison for sure.

For rest of the wonderful activities he is doing beating his mother [hope you are sure about this]  this one needs to be behind bars.

File a 498a case ASAP.

You need to take strict action against this person who is using violence against you sister

A lot of legal proceedings can be instituted against him, for domestic violence, for bigamy, etc.
