Time bound promotion

Air India Ltd had hold its time bound promotions for last 2 years as the merger process was not finalized. Now it had given the promotion to the employees with the effective date from when it was due but had denied the financial benefit.

The order mentions "The promotion will be effective from 31 Dec 2011. Financial bebefit will however accrure from the date individual takes over the charge of the new assignment after promotion."

 

In the context I would like to know whether the employees have a right to claim the financial benefit for the period they have not being given promotions as the delay was caused by the management and the employees had no fault in being denied the promotion for which they were due and no exercise was carried out"

I would like to get any judgement quotation in similar case if you can.

if TBC was part of service condition then financial benefit can be enforced from the due date.
