Stamp duty for a succession certificate is generally calculated based on the current market value of the assets, not the face value. In this case, the stamp duty would be applied on the present value of the shares, which is Rs. 10,00,000, and not on the face value of Rs. 70,000. With a 6% stamp duty rate, it will be calculated on the market value. It’s a good idea to consult a civil lawyer or a legal professional who specializes in inheritance and succession matters to ensure you're following the correct procedure and get clarity on the process.

With regard to succession certificates, stamp duty is usually computed based on the market value of the asset at the time the application is made rather than its face value. This is in accordance with the certificate's purpose, which is to establish the rights of legal heirs over the asset in its actual current worth.

In your illustration, where the shares carry a face value of ₹70,000 but a market value of ₹10,00,000, stamp duty at 6% is payable on ₹10,00,000 amounting to ₹60,000. In this way, the certificate captures the true present value of the inheritance because market value more accurately presents the economic value extracted from the shares.

Confirm the specific rules in your jurisdiction because stamp duty calculations might vary with some states. You would clarify any ambiguity by making enquiries at the local court registry.
