Spot resignation, employer issued no salary, experience lett

Hi, one of the employee served for 16months in an organisation and due he took 5 sick leaves and 4 casual leaves not in continuous days, as he met with an accident. Later senior managers said that his slary will be on hold and that too intimated him before 2 days of the salary day. After many discusaions on how they can hold the salary in the case when he has taken 5 sick leaves (as per that company they are giving only 5 sick leaves per year). As he is not satisfied with the answers he gave a spot resignation with serving any notice as his self respect didn't allowed him to continue his service. They are not even issuing the experience letter even, as he kept spot resignation though the employee accepted to not to have his salary for what he worked for the compete month. Can he claim on the emplyer, of yes suggest me.
