Service tax

sir we are service provider  and are providing MAnpower service to most of the Govt and MNC'S  , we are authorise firm will all legal documentation required for this business .  one of the case of our client which is a govt organization . during 2006-2007 for around 6 months the party  has payed us service tax on service charge i.e on receipt amount and not on the gross bill  after the scrutiny we demanded them to pay service tax on gross bill  which they agree later .but yet have not received the differential amount for this six month . we have contineously  demanded them throug letters but yet have not got their reply . orally they are telling but are not giving us in black and white. ST dpt are forcing us but they are not taking  into picture the company or any legal  action against company  .

service tax liability is on service provider like VAT. He may or may not recover it from its client.

but we have received service  tax on service charge and that we have paid . if we have got and have  not paid to govt then it will be a libility on us  right but we have not received then how come we can pay it from our pockets . we hardly get 5-8 % service charge and hw come we  should pay such a  huge amount . we have filed a case against them . just want to kw who will be responsible for this ..
