Rights for descendants of legal heir

Hi - Please share your thoughts on below scenario.

Immovable Property bought by Indian Christian Male who later deceased intestate leaving behind a wife, son, father, mother and 3 siblings. A legal heir certificate was obtained from Tahsildar listing intestate's wife, son, father and mother as heirs. No succession certificate was obtained. Now,

  • Does the father and mother have share/rights on the property?
  • If they do have shares, after the expiry of father & mother does their share get transfered to their descendants (that is, siblings of the deceased christian male)?
  • What is the right for the widow wife & son of the deceased christian male?

Raja, Yes father and mother have equal right on the property of their son as per Senior Citizens Act (If they fall in Sr. Citizens Category). If they die without WILL the same can be shared between 3 sibilings and wife of deceased son.
