Flat is currently in the name of my mother . She died without making nomination. There are 5 inheritors. 4 are for me becoming member, one is against. There is a deadlock.
Since NOC of one heir is not obtained, No transfer has been made. no membership is as yet obtained.
1 heir demands money for any NOC. and release of his share.
The payment for his share is not a problem . However,
Q : can this one heir sell his share with a release deed even before his share is legally transferred on the share certificate ?
or must the share transfer first be made before and person can relinquish his share ??
