I have a flat on my name ( clear title deed ). However I moved out of the flat some 20 years back due to some family issues. In the meantime my parents & brother lived in that flat & I stayed in another flat ( also on my name ). I was quiet all this while due to my parents as I wanted to give them a shelter to stay. Now after death of the parents , I have asked my brother to vacate flat ( since I have some financial difficulties ) but he flatly refuses. He has being paying society maintenance for the last 25 years. I also do not have share certificate since it may have been issued in the last 10 years while I was not staying there. I have definitely not received it.
I can always apply for duplicate share certificate but there is a procedure which involves putting up a notice in the papers or the notice board of the building ( which I am sure my brother will object to ).
Incase we are unable to reach an amicable situation , Where do I stand in this case ? Can I force an eviction via courts considering my brother has been staying for 25 years & pays society maintenance ? Approx How long will the court procedure take ?
