Partition suit

In a suit for partition preliminary decree passed ,plaintiff share declared some defendants remained exparte, can the defendants remaining exparte file final decree application after paying court fee

Final decree has to be passed by the Court after payment of necessary Court fees by depositing stamp papers.

The defendants may apply for setting aside prelimanary and final decree as per procedure.
