Income tax refund

Sir. for F.Y 2005-2006 and 2006-2007, it was found that the income tax refund of Rs.10 lakhs each was not received. Income tax returns were filed while showing the income tax refund in ROI and subsequently due to non follow up, it was skipped, now we found that for those two years refund was not received. So, kindly give opinon as to if I start follow up now, what are the chances of getting them.

Usually, it will be adjusted or will be credited to your account.  Now you remind them periodically for 3 times. If you have not received a reply then ask the reasons using RTI.

First, seek your opinion of your Chartered Accountant and then file RTI Application on line seeking information on reasons for not refunding the amount, and present status.  Invariably mention PAN No.   Date of Filing and enclose a copy of acknowledgment if any.  Most of these returns are uploaded by IT and your CA can easily verify such uploaded information.

It is better to consult your chartered accountant or engage a local prudent CA for analysing facts/ documents, professional advise and necessary proceeding.

In regard, firstly check you bank account properly, after that go with the NSDL website and check status of refund, if not found accordingly, you should be file an application before concern commissioner and incorporate all important facts. After a period gap as one or two week filed a WRIT Petition before appropriate Hon'ble High Court because a huge period gap founded in the present matter, it is beyond of limitation period. The concern administrative has not power to deal like this issue. Further, if any another queries please intimae the same.
