House property and getting tslr

House Property - TSLR Requirement.

Dear Sirs/Madam,   Party M purchaserd a plot of land of  10 cents in Tamilnadu out of his own income.   Builder B developed it into 10 Flats and out of which 2 Flats (Flat 1 and Flat 2 ) were given to M and the rest of 8 Flats were sold by the Builder to different parties   M bequeathed by will ,his Flat 1 to his only daughter D in Jan 2024 and sold Flat 2 for investments in Gold and MF. He died in early Feb 2025.   

After getting the death certificate and legal heir certificate the will was registered in May 2025.
Now in July 2025 D wants to sell the Flat 1.   Before selling she has to take TSLR.  (None of the 10 flat Owners have obtained theTSLR sofar.).

Qn. 1.   Is it enough for daughter D to get TSLR pertaining to her property (Flat 1) only. 

Qn. 2.   Now  whether all the other  9 Flat owners should also take the TSLR now itself (simultaneously) for D to sell her FLAT1.

Qn.3.     For D to take the TSLR now whether other Flat owner's signature required?

Qn 4.    Whether the  other 9 Flat owners can take the TSLR later  at their own conveneient Dates.   .

Yes, D can apply for TSLR for Flat 1 individually, provided the flat has a clearly defined undivided share (UDS) of land and the builder has properly documented the subdivision.

TSLR is issued based on survey numbers and ownership records, so if Flat 1 has a distinct UDS and mutation is complete, D can proceed independently. 

 Q2: Do all 9 other flat owners need to apply for TSLR simultaneously?

No, simultaneous application is not mandatory. Each flat owner can apply for TSLR for their respective flats at their convenience.

However, if the land parcel hasn’t been subdivided in the TSLR records yet, it might require a collective application or clarification from the Revenue Department1. ✍️ Q3: Are other flat owners’ signatures required for D’s TSLR? Not necessarily. If the builder has already registered the flats with individual UDS and the mutation is reflected in the revenue records,

D can apply without needing signatures from other owners. But if the TSLR record still shows the entire land under a single owner or lacks subdivision, a joint affidavit or NOC from other owners may be requested by the authorities. 📅

Q4: Can other flat owners apply for TSLR later? 

Absolutely. Each owner can apply for TSLR at their own convenience, unless the Revenue Department insists on a collective update due to lack of subdivision or mutation. It’s advisable for all owners to eventually obtain TSLR to avoid future legal or financial complications. If D is facing delays or complications, she might consider consulting a local surveyor or legal expert to ensure the mutation and subdivision are properly recorded

TSLR is Town Survey Land register, is an official land Record maintained  by the TamilNadu Revenue Departmengt, primarily for urban areas.

TSLR extracts are essential for verifying ownership, boundaries, and other details related to land within town limits

 TSLR (Town Survey Land Register) permission is not mandatory before selling a flat in Tamil Nadu

While a TSLR extract is important for verifying land ownership in urban areas and is often required for property transactions, it is not a mandatory document for the sale of a flat. 

When selling a flat, the primary documents are the registered Undivided Share (UDS) Sale Deed, the Construction Agreement (if applicable), and up-to-date property tax and utility bills, all in the seller's name

In essence, while TSLR is a valuable document for verifying land details in urban areas, it's not a mandatory document for selling a flat. The primary documents for flat sales are related to the apartment itself and the underlying land, including the UDS.
