Dear Experts,
My wife filed 498a and DVC cases on last year. 498a is filed on my parents, my
2 brothers and their wives. Myself and my wife were in abroad for 8 months and
she left me and went to her home,India in 2011 september. after one year 6 months
(March , 2013) She filed 498a on my family. In June 203, She filed DVC on 10
memebers(498a accused persons + 3 other relatives). Now I am planning to go for Quash on
DVC. DVC is about to start trail.
1. she filed DVC after 1 year 9 months domestic/physical seperation from me.
2. My parents are staying seperately.My elder brother and his wife living
seperately. my younger brother also living seperately. we are not living as
joint family from more than 10 years. even me also living seperately with my
family after my mariage. But all are living in same town. we are all have
different address prrofs(Adhar card, ration card, voter id) also.
3. The other 3 relatives are living other cities and not in my home town. and
we have identity and addres proofs of them.
4. all allegations/complaints made in 498a and DVC are almost same. except on
me, she alleged that I had taken her jewelleries from her.
Experts, Please suggest me on which grounds I can go for quash in High
court? How much success rate I will get If I go for quash?
